Proposed Road Discontinuance

Whitehorse City Council (Council) gives notice under clause 3 of Schedule 10 and sections 206 and 223 of the Local Government Act 1989 (Act), that it proposes to:

  1. discontinue that part of the road known as Beresford Street, Mont Albert shown hatched on the plan below (Parcel A) - being part of the land contained in certificates of title Volume 11660 Folio 936 and Volume 12075 Folio 831 - and retain ownership of Parcel A, which will be incorporated into the Mont Albert Village Plaza (Proposal A); and
  2. subject to the Level Crossing Removal Project declaring that part of the rail corridor shown cross hatched on the plan below (Parcel B) - being part of the land in certificate of title Volume 12075 Folio 830 - to be a road under the Major Transport Project Facilitation Act 2009 (Vic), discontinue and retain ownership of Parcel B, which will be incorporated into the Mont Albert Village Plaza (Proposal B).

If Council resolves to proceed with Proposal A, the balance of Beresford Street as constructed will remain open to vehicle and pedestrian traffic.

Any person may make a submission on either Proposal A or Proposal B, or on both Proposals A and B.

Any person wishing to make a submission under section 223 of the Act must do so in writing to the undersigned. Council must receive submissions no later than Thursday 25 July 2024.

All submissions will be considered in accordance with section 223 of the Act.

Any person making a written submission and requesting to be heard in support of their written submission is entitled to appear in person or may be represented by a person acting on their behalf; before Council on Monday 12 August 2024 at 7:00pm at the Council Chamber, Nunawading Civic Centre, 379-397 Whitehorse Road, Nunawading.

Following the consideration of any submissions, Council may decide to discontinue and retain the land, or not to discontinue.

Any person making a written submission under section 223 of the Act is advised that all submissions and personal information in the submission will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.
