A Council permit is required to place an obstruction on Council land, Council road, nature strip, road, footpath, crossing or lane-way which may cause an obstruction to pedestrians or vehicles or may constitute a danger.
Who Can Apply for a Permit
Residents of Whitehorse may apply for a permit.
Permit Application Considerations
Council must receive permit applications at least 48 business hours prior to the placement of the obstruction. To avoid fines or impoundment, successful permit applicants must adhere to the permit conditions.
The Permit assessment process may include an inspection of the site.
Once the Permit Application is approved, the Permit will be emailed to the applicant.
Obstruction Permit Conditions
Permit Conditions
- The permit holder must ensure that all the permit conditions are complied with at all times.
- The applicant must provide evidence of $20 million of public liability insurance for the permit period.
- The permit is not transferrable:
- Permits are not to be photocopied and the copies used by someone not named on the permit
- Permits are not to be leased, sold or given away
- No form of advertising of a permit for rent, lease, sale profit or other beneficial or fraudulent consideration of causing such an advertisement to be published is permitted.
- This permit is valid only for the stated time period.
- The placement of the obstruction must conform to the:
- A minimum unobstructed distance of 1.8 metres must be maintained from the property line and 0.5m from the kerb at all times.
- Council will NOT allow, without a valid Council permit, the installation of permanent structures on Council land.
- The permit is only valid for one obstruction at the nominated location.
- The obstruction must:
- Be placed in such a way as not to obstruct manholes, hydrants, telephone boxes, taxi ranks and tram and bus stops
- Not be placed on a hill or curve where the view is not clear for at least fifty (50) metres
- Have attached hazard lighting and/or reflective tape when situated on roads so approaching motorists can identify the extent and form of the obstruction
- Be placed so as not to cause danger to the normal flow of traffic or restrict traffic movements.
- The permit holder or their representative must comply with general parking regulations in the area of placement, unless otherwise agreed to by Council. An obstruction permit will not override any clearway or freeway parking restrictions.
- Obstructions not make the land visibly repugnant or detrimental to the general amenity of the area (Whitehorse Community Local Law 2024 ( PDF 973.95KB) S 2.9) and must be kept in an acceptable state of repair and cleanliness:
- Spillage must be cleaned up immediately
- Obstructions must be kept clear of graffiti
- At the conclusion of the permit period a new application form must be submitted.
- The permit must be produced for an Authorised Council Officer on request.
- The permit holder will comply with all directions by a member of Victoria Police or Authorised Council Officer, including a direction that the skip bin be removed from that site.
Permit Condition Breaches
If the permit holder breaches the permit conditions:
- The permit may be cancelled.
- Penalties may be applied.
- Costs incurred by Council may be charged directly to the permit holder.
- Goods or equipment may be impounded.
- Future permit applications may be declined.
