Whitehorse City Council gives public notice of its proposal to permanently close and discontinue the road located at the rear/side of 153-159 Springvale Road, Nunawading VIC 3131.

This notification is pursuant to Clause 3 of Schedule 10 of the Local Government Act 1989.

Following discontinuance, it is proposed to sell the land by private treaty to the adjacent landowner. The price would be not less than the independent valuation obtained by Council.

The road proposed for discontinuance is not on the Council Roads Register. The road services only the adjacent four allotments/properties and is no longer reasonably required for public use. The road is shown hatched on the plan below. 

The proposed road discontinuance and sale will be as per statutory requirements, specifically Section 9 of the Road Management Act 2004 section 206, and Schedule 10, Clause 3 of the Local Government Act 1989. In addition, this is covered under Council ‘Discontinuance of Roads policy, May 2024’ (which is publicly available on the Council website).  

Any person wishing to make a submission on the proposal must do so in writing. Any submission must be received by Council no later than Monday 25 August 2025.

• Or deliver your written feedback in person to our Customer Service staff at the Whitehorse Civic Centre, 379-397 Whitehorse Road Nunawading. Please make sure you quote reference No 52/07/391  

Any person making a written submission and requesting to be heard in support of their written submission is entitled to appear in person or may be represented by a person acting on their behalf before a Council Meeting on 22 September 2025 at 7.00pm at the Council Chamber, Whitehorse Civic Centre, 379-397 Whitehorse Road, Nunawading. Any submissions received will be included in the Council agenda.

Following consideration of any submissions, Council may decide to discontinue the road, part of the road, or not to discontinue the road.

Any feedback and submissions will inform the Council decision on this proposal. All submissions will be considered in accordance with Sections 207A and 223 of the Local Government Act 1989.
